Violence against Women a Violation of her Human Rights

Palestinian Women, like women around the world suffer daily from violations of their basic human rights. They are continuously exposed to different forms of gender based violence. In Palestine, gender based violence vary from one case to another, ranging from everyday discrimination to atrocious murders. The legislative, executive and legal authorities have failed to provide Palestinian women with the security they require.
The Palestinian Basic Law demonstrates that women and men have equal citizenship rights.
However, the PLC has not yet issued the new Palestinian Penalties law, which was anticipated to offer women protection under the law. On the contrary, the Jordanian and Egyptian Penalties Laws that were issued in 1966 still govern the West Bank and Gaza. Despite the presidential decree, which suspended the articles that justify and legitimize honor killing, the road to a democratic society that honors women’s right to live in security is still long. Hence, the failure to ensure legal protection of women against violence is considered as a violation of the principle laws of the Palestinian Basic Law.
We confirm that international conventions that were acknowledged as applicable in Palestine by the Basic Law, clearly affirm women’s rights to absolute security from all forms of violence. In this regard, we believe that it is time to enforce necessary procedures which guarantee the implementation of the two presidential decrees endorsing UNSCR 1325 and CEDAW on ground, on the legislative, executive and legal levels, in order to ensure women’s security.
As Palestinian women played an essential role in the national struggle for freedom and independence, their issues needs to be taken into consideration when the laws and procedures are
issued. They need to be protected and to have their roles in the communities firmly acknowledged.
On the eve of launching the International Campaign to combat Violence against Women, the PWWSD demands:
  • To rapidly issue progressive Penalties and Family Laws, based on gender equality and in respect with CEDAW.
  • To activate the presidential decrees endorsing CEDAW and UNSCR1325, and the related executive procedures.
  • To work on protecting women from all forms of violence, and to ensure persecution of femicide perpetrators.
  • To promote services provided for violated women, in addition to provide safe shelters for them under the supervision of the polic
  • For the PA to increase the allocated budget to protect women against violence.
  • To remove the perpetrators from the house, arrest them and rehabilitate them on government’s expenses.
  • To issue a law that guarantees and social insurances to combat poverty and marginalization of groups of women, including the housewives and the female workers of the informal sector.
  • To increate the Police’s sensitivity and awareness about women’s issues and the violence practiced against them.
Together for a society that respects women’s humanity and protects them from violence
